US EPA Proposes Full Reallocation of 770 Million Exempted Biofuel Credits
Biofuel Credit Reallocation
The US Environmental Protection Agency is proposing to reallocate the full 770 million exempted renewable identification numbers (RINs) from recent small-refinery exemptions into future renewable fuel obligations (RVOs), and is seeking feedback on two approaches.
The agency is asking whether to split the volume evenly between the 2026 and 2027 RVOs, or reallocate the entire amount to the 2027 obligation. “As our farmers continue to harvest their crops, today’s proposal is working to maintain a strong and durable market for them to sell to,” EPA administrator Lee Zeldin said during a visit to Peosta, Iowa.
The proposal follows the EPA’s August decision to grant 29 small-refinery exemptions covering 1.76 billion RINs from the 2025 compliance year. The agency had previously estimated 990 million RINs would be exempted, leaving 770 million to account for. Small-refinery exemptions go to refiners that prove purchasing RINs creates “disproportionate economic hardship” and run no more than 75,000 barrels per day of crude throughput.
The reallocation lands against two record blending mandates — 26.81 billion RINs for 2026 and 27.02 billion for 2027. Any revision to the 2026 RVO could also extend the 31 March 2027 compliance deadline. Public comments close on 4 December 2026.
For renewable-fuel producers, the direction of travel is what matters: rather than letting exempted volumes simply vanish, the EPA is re-injecting them into forward obligations. That keeps a durable, predictable credit market in place for biomethane, renewable natural gas and waste-derived fuels.
